Red Alert 'Rules'
Our red alert ‘rules’ have been designed to help you avoid or reduce the value of any claims. This list is not comprehensive, does not form part of our terms and conditions and may be added to and/or changed at any time – but we urge you to follow the ‘rules’.
- Make any contract or agreement in writing or at least confirm oral agreements in writing. Collect any evidence, which could be of relevance to support your position
- Put any later changes or additional agreements in writing, have them signed by your counter party or at least confirm them in writing to your counter party
- Make sure that your ship can safely reach the port of loading or discharge before agreeing on a load or discharge port in a Voyage Charter Party
- Put a copy of the relevant Charter Party on board of your vessel as soon as possible and alert your master of any important and unusual condition
- Tender Notice of Readiness for loading and discharging as soon as possible under the relevant Charter Party
- Give any Notice of Commencement of Demurrage in writing
- Collect and keep evidence for any delay or interruption of loading and unloading
- Instruct your master to keep a copy of any authority he issues in favour of agents etc
- Any authority to sign Bills of Lading for the master or the owner must include the condition that the agent must enter remarks included in the Mate's Receipt into the Bill of Lading
- Never issue a Bill of Lading with incorrect date or incorrect description of quality, quantity or condition of cargo loaded. Instruct your master to contact you forthwith if required to sign Bills of Lading if he is not sure whether the cargo is described properly
- Deliver cargo only against an Original Bill of Lading and keep the original in your office, if possible
- Make an own tally of cargo loaded and discharged and keep evidence
- If your ship is on time charter, instruct your master to accept any kind of services or deliveries, which you have not ordered yourself, only with an express notice that the ship is on time charter and that the service or delivery is accepted for and on behalf of the time charterer
